User Agreement & Terms and Conditions

This User Agreement governs your use of Makeba’s services, website, and mobile applications. Please read it carefully.

1. Overview of the Service

  • The Service allows sending/requesting money transfers, mobile reloads, and bill payments.
  • Use the Service only with people you know personally.
  • Makeba’s service is sponsored by [SPONSOR BANK], a federally licensed bank.
  • Always protect your account credentials and report suspected fraud immediately via +1 (212) 264-2020 or fraud_investigations@makeba.money.

2. Accessing the Service

  • You must be at least 18 years old and legally capable of entering into contracts.
  • Mobile access may incur standard data or service charges.
  • Bill payments require authorization from the Beneficiary.
  • The Service may be unavailable in certain jurisdictions.

3. Offer and Acceptance

  • Submitting a transaction is an offer which Makeba may accept or reject at its discretion.

4. Payment

  • Transaction fees apply in addition to the Transaction Amount.
  • Payments are accepted in USD only. Makeba may debit your account to confirm ownership.
  • Other charges imposed by financial institutions are your responsibility.
  • Foreign currency exchanges may include spreads; you agree to fund transactions in the currency of the recipient account.
  • Scheduled transfers must be made at least 5 business days in advance. Cancellation rules apply as described.

5. Transaction Payouts

  • Makeba works with local banks and service providers to deliver funds or mobile reloads.
  • Recipients may be required to verify identity using valid ID and transaction information.
  • Makeba is not responsible for incorrect account information provided by the Sender.

6. Restrictions

  • Makeba may refuse or limit transactions at its discretion.
  • Transactions may be delayed or canceled for verification, fraud prevention, legal compliance, or other reasons.
  • Unauthorized activities include illegal transactions, scams, fraud, gambling, or violations of this Agreement.
  • Not all Payment Instruments or Recipients may be eligible for transactions.
  • Transactions on behalf of others, businesses, or charities require express consent.

7. Collection of Information

  • All information collection is governed by Makeba’s Privacy Policy.
  • Makeba may verify your identity and collect information to comply with anti-money laundering and terrorism financing laws.
  • Google’s Invisible Recaptcha may be used to prevent illegal activity.

8. Errors and Problems

  • Dispute transaction errors within 180 days via +1 (212) 364-2020 or online.
  • Transactions can be cancelled within 30 minutes for a full refund unless already paid.
  • Right to refund: You may receive a refund if funds are not transmitted within 10 days.

9. Intellectual Property

  • All content, logos, software, and trademarks are the property of Makeba.
  • Users may not copy, modify, or reverse engineer Makeba’s intellectual property.

10. Disclaimer of Warranties

  • The Service is provided “as is” without warranty of any kind.
  • Transactions may be subject to delays due to factors beyond Makeba’s control.

11. Indemnity

  • You agree to indemnify Makeba and its affiliates against claims arising from your use of the Service or violation of this Agreement.

12. Limitation of Liability

  • Makeba’s liability is limited to $500, in addition to transaction refunds.

13. Dispute Resolution and Governing Law

  • This Agreement is governed by New York law.
  • Disputes under $10,000 may be resolved through arbitration. Claims must follow the dispute procedures outlined herein.

14. Electronic Communications

  • All communications, including this Agreement, transaction records, and notices, are provided electronically.
  • Consent withdrawal terminates your use of the Service.

15. Miscellaneous

  • Keep contact information updated.
  • Makeba may modify this Agreement; continued use implies acceptance.
  • English version prevails in case of inconsistency with translations.
  • Export laws and Apple-specific terms apply as described.

  • You consent to receive autodialed or prerecorded calls/texts for service, fraud prevention, or debt collection.
  • Marketing calls require prior consent.
